The Court of Appeal has confirmed that FOS has jurisdiction to deal with complaints relating to PPI underwritten by Assurant, that was sold by home shopping retailers in the early 2000s, before insurance distributors fell within FCA’s regulatory remit. FOS had accepted jurisdiction to deal with complaints on the basis that the retailers were acting as agents of the insurer. The insurer appealed this decision, but Court of Appeal agreed that on the facts and the substance of the matter, the retailers were tied to marketing the policies of the insurer and were acting as its agents.
