The FCA has updated its website page on use of trading names. The page explains:
- how to add trading names to the Register;
- how the FCA checks whether a name is a genuine trading name (specifically, that the name is really one that the firm uses, and is not the name of another business);
- using sensitive names and how to check with the FCA whether a sensitive name is acceptable;
- what the FCA looks for when analysing whether a name could cause consumer harm; and
- breaches involving trading names – including that firms should not use trading names as alternatives to registering separate legal entities that should be ARs.
