FCA has updated its list of documents relating to the business interruption insurance test case in preparation for the trial starting on 20 July.
The documents now published are:
- the agreed list of issues and common ground: this deals with the following, including details of particular issues with particular policy wordings:
- disease occurrence and vicinity;
- prevalence;
- public authority action;
- exclusions;
- other matters of construction;
- causation;
- qualification and trends clauses; and
- declarations
- agreed facts relating to:
- the chronology of the Government response to Covid-19
- the Covid-19 disease
- the prevalence of Covid-19 (still being agreed at the end of 17 June)
- Notification procedures
- Sweden
- earlier pandemics
- economic impact
- distribution channels
- Scilly Isles
- a new list of Assumed Facts, that have developed from the previous assumed facts, and are based on defined categories of business with assumed facts applying to them.
