FCA plans to fine individual for disclosure failures

The FCA has decided to find the Chief Executive of BancTrust, Carlos Fuenmayor, nearly £100,000 for having failed to tell the FCA about 3 issues that would have been material to its assessment of his fitness and propriety. The FCA believes the failures put Mr Fuenmayor in breach of APER Principle 4/Senior Manager Conduct Rule 4. He has referred the decision to the Upper Tribunal.
