Following the much awaited Supreme Court judgment in the Johnson, Wrench and Hopcraft cases, FOS has announced that the Court of Appeal hearing on DCAs in motor finance will take place from 16 – 18 September 2025. The hearing had been adjourned from 1 – 3 July 2025 pending the Supreme Court judgment in the above cases.
In late 2024, the High Court found in favour of the FOS in a review of its decision to uphold a complaint relating to a DCA in a motor finance agreement. Shortly after this decision, the FCA extended its temporary pause on the usual timeframes firms have to respond to non-DCA motor finance complaints.
Clydesdale Financial Services (trading as Barclays Partner Finance), the lender in the relevant FOS case, was granted permission to appeal the High Court judgment in early 2025.
