The Competition Appeal Tribunal has refused Mastercard leave to appeal on the issue of what the “domicile date” should be in the Collective Proceedings Order granted in the collective action brought by Walter Merricks. Mr Merricks contended it should be 6 September 2016 (the date the claim form was submitted). Mastercard said it should be the date the CPO was granted (in August 2021 – so around 5 years later). Mastercard’s contention would have had the effect of taking any individual who died between the two dates outside the class. The CAT rejected Mastercard’s two grounds of appeal.
