Emma RadmoreThe FCA has updated its website to make more prominently the comments made by Nikhil Rathi on the current state of the complaints pause in relation to DCAs and the possibility that it could now be expanded to other motor finance complaints pending the results of the almost certain appeal against the Court of Appeal judgment on non-disclosed commissions.
As we commented, the FCA has acknowledged that it needs clarity on what the final court position will be, but is clear that, if the Court of Appeal decision is not changed, firms will need to handle complaints in line with it.
