The FCA is consulting as promised on extending the time firms have to respond to motor finance complaints involving non-discretionary commissions. The FCA notes that firms are likely to receive high levels of complaints following the recent Court of Appeal judgement. It is asking for views on whether it should extend the time firms have to give final responses on these complaints:
- until 31 May 2025, reflecting how long it may take to hear whether the Supreme Court has granted permission to appeal; or
- until 4 December 2025 in line with the current pause for discretionary commission arrangement complaints.
The consultation has a short response period, closing on 5 December. The FCA then hopes to publish its policy statement by 19 December.
