HM Treasury has published a policy note and draft of the proposed statutory instrument which, if approved by Parliament, will allow the FOS to charge case fees to CMCs and other relevant professional representatives who submit cases to the FOS on behalf of complainants. Currently, the FOS can only charge case fees to the respondent firms themselves.
The FOS will consult these fee proposals as part of its plans and budget for 2024/25. It expects to start charging fees by the end of Q3 2024.
