ASA confirms scope of advertising restriction on unregulated investments

Following consultation, the ASA has confirmed that the BCAP restriction on advertising “unregulated investments” applies only to financial products that a layperson would generally consider to be “investments” – that is, something into which they would pay with expectation of a return. The clarification is designed to remove the doubt as to whether products such as unregulated BNPL products were subject to the ban. However, the ASA is keen to be sure to get this right and will review the clarified wording after 12 months to check it has achieved the desired effect.
